Scope


The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded via the online store of titikas.ch (hereinafter referred to as "titikas") (hereinafter referred to as "order").

titikas.ch reserves the right to change the GTC. In each case, the version of the GTC valid at the time of the order is decisive, which cannot be unilaterally

Offer

The offer is aimed at natural customers with residence or legal entities domiciled in Switzerland or Liechtenstein. Deliveries are only made to addresses in Switzerland or Liechtenstein.

The offer is valid as long as it is visible in the online store and/or stocks last. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, in the online store

Price

The prices are in Swiss francs, including value added tax (VAT) and, if applicable, including an advance recycling fee ("vRG").

The price in the online store at the time of the order is decisive.

Order

The presentation of the products in the online store is not a legally binding request, but a non-binding online catalog or a non-binding request to the customers to order the product in the online store. titikas.ch reserves the right to limit the delivery quantities for certain products and not to carry out the delivery if the order is unusually heavy or voluminous.

An order is considered an offer to titikas.ch to conclude a contract.

There is no minimum order value per order. The minimum order values communicated in the online store as well as the delivery costs guideline are valid, payment by payment slip must be made before delivery.

After transmission of the order, the customer will automatically receive a confirmation of receipt, which documents that the order has been received by titikas.ch. The customer can only supplement or cancel the order until it is processed. If an order is supplemented, the original order will be used as the basis for calculation, but possible special offers and discounts at the time of the supplement will not be taken into account.

titikas.ch is free to refuse orders in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of products which are not available. Temporarily unavailable products cannot be reserved.

Contract conclusion

A contract is only concluded when the order is processed by titikas.ch. As soon as the order is ready for shipment, the customer will receive an order confirmation by e-mail.

Delivery

Delivery area

The customer's delivery address must be in Switzerland or the Principality of Liechtenstein.

Delivery times

The available delivery time ranges can be seen in the online store. Deviations in time as well as the blocking of a certain delivery date are possible, especially on peak days with exceptionally high delivery volumes, whereby any claims for damages as well as further claims of the customers are excluded.

No deliveries are made on Sundays and official national or cantonal holidays.

If the customer is not on site at the time of delivery and has not given any specific delivery instructions, the delivery will be deposited at the door of the apartment or at the reception or at the entrance door of the company. If the customer's mailbox is part of a mailbox system, the delivery person will leave an invitation for collection in the mailbox. The customer must then pick up the delivery at the corresponding post office.

The customer is responsible for the products delivered, even if they have not been received directly.

The delivery costs are included with titikas.ch. The delivery costs communicated in the online store and the delivery costs guideline apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

Notice of defects

If products with obvious damage to the packaging or contents are delivered, the customer must immediately complain to the delivery agent and refuse acceptance, without prejudice to his rights to claim for defects. The customer is obliged to receive a damage confirmation from the delivery person. All transport damages are to be reported additionally immediately to titikas.ch.

Further it is incumbent on the customer to examine the ordered products immediately upon receipt. For any defects or deviations from the order, the customer service of titikas.ch must be notified on the day of delivery either by telephone on the number +41 (0) 62 562 84 38 or by e-mail info@titikas.ch. After this, only hidden defects can be claimed within 7 days, which must be reported to the customer service of titikas.ch immediately after discovery. The amount paid by the customer for the defective goods will be credited to the customer account. titikas.ch reserves the right to demand proof of the defect.

Payment options

Payments must be made in Swiss francs.

Electronic means of payment

Credit cards (Visa, Mastercard, American Express) and debit cards (Postcard) are accepted as means of payment. If you pay by credit card or debit card, the amount will be debited by titikas.ch after the order has been placed.

Purchase on account

titikas.ch can exclude the payment option purchase on account without giving reasons. In the case of purchase on account, the customer must have their residence or registered office in Switzerland or Liechtenstein and pay the amount in advance.

Refunds and credits

If the customer is entitled to refunds or other credits, these will be credited. A credit may take several days to be issued.

Applicable law and place of jurisdiction

The legal relationship between titikas.ch and its customers is subject to Swiss substantive law, excluding conflict of laws norms and the Vienna Sales Convention.

Place of jurisdiction for natural persons is Lenzburg or the residence of the customer. The exclusive place of jurisdiction for legal persons is Lenzburg.
